BDG: Legal Counsel

The Committee may require assistance from legal counsel in matters related to the operation of the district.

Requests for legal advice, clarification, or confirmation by Committee members will be directed to the Chairman who will consult the City Solicitor to determine whether the resources required to adequately address the issue will be most effectively and efficiently supplied by the City Solicitor or outside counsel. The Chairman will consult appropriate counsel, consult/collaborate with the Superintendent regarding expected budgetary impact, and report back to the requester in a timely manner.

Requests for legal advice, clarification, or confirmation by the Superintendent will be directed to the City Solicitor to determine whether the resources required to adequately address the issue will be most effectively and efficiently supplied by the City Solicitor or outside counsel. As in all matters of budgetary responsibility, when outside counsel is consulted, the Superintendent will ensure that sufficient resources exist within the budget as approved by the Committee, and that Committee policy is followed if transfers among or between line items is necessary. When the Superintendent concludes that unusual types or amounts of professional legal service may be required, he/she will advise the Committee and seek either initial or continuing authorization for such service

The designated legal counsel—either outside counsel or the City Solicitor—will attend meetings upon request and will be sufficiently familiar with all applicable laws as well as Committee policies, practices, and actions under these policies in order to provide high-quality legal advice.

Invoices for outside counsel will contain enough detail to provide expense transparency to the Committee and community without violating privacy laws or unduly burdening the Superintendent, and will be available to all Committee and community members in accordance with Public Records Laws.
